By using this website, you agree to ON THE PATH, LLC’s terms and conditions of use without limitation or qualification. ON THE PATH, LLC reserves the right to modify its terms and conditions at any time.

ON THE PATH, LLC is a limited liability company organized and existing under the laws of the State of Michigan, with a primary place of business located at 701 E. Savidge St. #3, Spring Lake, Michigan, 49456.

ON THE PATH, LLC offers yoga and health goods and services under the assumed name On The Path Yoga, The Vital Path, and related designations.

ON THE PATH, LLC represents and warrants ownership of the mark and trade name On The Path Yoga, The Vital Path, and related designations for yoga goods and services including yoga studios, exercise, health and fitness instruction, training programs, workshops, and consultations.

Any reproduction, or use of the mark On The Path Yoga without prior written consent from ON THE PATH, LLC is unlawful.

INTELLECTUAL PROPERTY RIGHTS

This site is protected by copyright, trademark, and other intellectual property rights. All content in this website including trademarks, text, graphic, logo, coding, videos, etc. are the property of ON THE PATH, LLC and protected by United States and International copyright laws, or are used under license or permission of the respective owners.

DISCLAIMER

This website may contain links to third-party websites. ON THE PATH, LLC does not provide any express or implied warranty regarding any performance of third-party websites. The website user assumes all risk.

LIMITATION OF LIABILITY

GOVERNING LAW AND CONSENT TO JURISDICTION

By accessing this site you agree these terms shall be governed by and construed in accordance with the laws of the State of Michigan, USA. You agree to consent to the jurisdiction of the courts of the State of Michigan in any dispute concerning any provision of this Agreement.

PARTICIPANT LIABILITY AND RELEASE WAIVER

By voluntarily participating in any On The Path Yoga class, training, workshop, or other service I agree to the participant terms of this agreement including the acknowledgements below:

As a participant in yoga classes, programs, workshops, online materials, and events offered by On The Path Yoga during which I will receive information and suggestions about yoga, health, and fitness; I recognize that the activities I participate in at On The Path Yoga require physical exertion which may be strenuous and may cause aggravated physical injury, and I am fully aware of and willingly assume the risk and hazards involved.

I understand that it is my sole responsibility to consult with a physician prior to my participation in any of the classes, programs, workshops, online materials, and events at On The Path Yoga. I represent and warrant that I am physically fit and have no medical condition which would prevent my full participation in these activities.

In consideration of being permitted to participate in any of the classes, programs, workshops, and events at On The Path Yoga, I agree to assume full responsibility for any risk, injuries, or damages, known or unknown, which I might incur as a result of participation in the activity. I agree to inform my instructors of any physical limitations, discomfort and or injuries before or during classes and I take full responsibility for my own actions and my own limitations.

In further consideration of being permitted to participate in any of the classes, programs, workshops, and events at On The Path Yoga, I knowingly, voluntarily and expressly waive, renounce and disclaim any claim I have or may have against On The Path Yoga, its instructors, contractors, directors, partners, owners, and employees for loss, theft or damage of any personal property from the On The Path Yoga premises, for injuries or damages that I may sustain within the On The Path Yoga facility, and/or for injuries or damages that I may sustain as a result of participating in the classes, programs, workshops, and events at On The Path Yoga. I forever release, waive, discharge, and covenant not to sue On The Path Yoga for any injury or death caused by their negligence or other acts that are not intended to harm me.

PHOTO, IMAGE, CONTENT RELEASE

Any submissions to this website in either text or image form may be reproduced by On The Path Yoga for use on this site.

I grant to On The Path Yoga, its representatives and employees the right to take photographs and videos of me and my property in connection with my participation in On The Path Yoga classes and programs. I authorize On The Path Yoga, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that On The Path Yoga may use such photographs and videos of me with or without my name and for any lawful purpose, including but not limited to such purposes as publicity, illustration, advertising, and web content. I hereby waive the right to receive any payment for signing this release and waive the right to receive any payment for On The Path Yoga’S use of any of the material described above for any of the purposes authorized by this release.

REFUND AND CANCELLATION POLICY

All payments must be paid on or before their due date. Membership fee refunds or holds may be arranged in cases of medical or other restrictions. Appropriate documentation of the reason for your cancellation may be required.

If a class, workshop, event, or appointment is cancelled by On The Path Yoga and not rescheduled, a refund may be issued for any portion of the program that is incomplete.

Workshop, membership, punch card, day passes, and other event fees are nonrefundable. Notice of an appointment cancellation with ON THE PATH, LLC must be given 24 hours in advance. On The Path Yoga reserves the right to refuse service to anyone. On The Path Yoga reserves the right to amend this policy.

The decision to issue a refund or place a membership on hold is at the sole discretion of ON THE PATH, LLC.

PRIVACY POLICY

We may collect information from you when you register on our site, subscribe to our newsletter or fill out a form. Any of the information we collect from you may be used in one of the following ways: To personalize your experience (your information helps us to better respond to your individual needs), To improve our website (we continually strive to improve our website offerings based on the information and feedback we receive from you), To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs), To administer a contest, promotion, survey or other site feature, To send periodic emails.
